1. Acceptance of Terms
By accessing or using Tabor Map ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
You must be at least 13 years old to create an account. If you are under 18, you may only use the Service with the permission of a parent or guardian, who must agree to these Terms on your behalf. Optional features that rely on your consent, such as Discord DM notifications, require you to be at least 16, or to have that permission.
2. Description of Service
Tabor Map is a community-run interactive mapping service for the game Ghosts of Tabor. We provide tools to view interactive maps, submit and share marker locations, plan routes, collaborate through comments and forums, and access community-compiled game information.
The Service is provided free of charge and maintained on a voluntary basis. We may change, suspend or discontinue any part of it at any time.
3. No Affiliation with the Game Developers
Tabor Map is an unofficial, fan-made project. It is not affiliated with, endorsed by, sponsored by, or approved by any developer, publisher or rights holder of Ghosts of Tabor.
"Ghosts of Tabor" and all related names, logos, characters, locations and imagery are trademarks and copyrighted works of their respective owners. They are referred to here only to identify the game this community resource relates to. No claim of ownership over them is made or implied, and nothing on this Service should be treated as an official source of information about the game.
4. User Accounts
To use certain features you must create an account, either with an email address and password or by signing in with Discord. You agree to provide accurate information, keep your credentials secure, notify us promptly of any unauthorised access, and accept responsibility for activity under your account.
We may suspend or terminate accounts that violate these Terms. You may delete your account at any time; see the Privacy Policy for what happens to your data.
5. User Conduct
You agree not to: submit false or misleading information; use the Service for any unlawful purpose; harass, threaten or harm other users; upload malicious code; attempt unauthorised access to any part of the Service or its infrastructure; impersonate any person; spam or advertise without authorisation; post content that infringes anyone's intellectual property or privacy rights; or post obscene, hateful or otherwise offensive content.
The restrictions on automated access in Section 8 apply in addition to the above.
6. Your Content and the Licence You Grant Us
"Your Content" means everything you submit: markers, routes, comments, forum posts, messages and images. You remain its author. German law does not allow copyright itself to be transferred (§ 29(1) UrhG), so authorship stays with you and cannot be signed away; what you grant instead is the right to exploit it, set out below.
By submitting Your Content, you grant the operator of Tabor Map an exclusive, worldwide, royalty-free, perpetual, transferable and sublicensable right of use (ausschließliches Nutzungsrecht, § 31(3) UrhG), for all types of use known at the time of submission.
That right covers hosting, storing, reproducing, adapting, modifying, translating, publishing, publicly displaying, distributing and making available Your Content, and incorporating it into the Tabor Map database and any compilation or derivative of it, for the purposes of operating, promoting and improving the Service.
What "exclusive" means for you. For as long as this grant lasts, we alone may exercise those rights, including as against you. In practice: if you want to reuse your own contribution somewhere else, ask us first at info@tabormap.com. We will not unreasonably refuse permission for you to reuse your own work, and normally we will simply say yes. This grant exists to stop the community's collected work being lifted wholesale by third parties, not to stop you using what you made.
This grant is perpetual because contributions become part of a collective, continuously maintained dataset that cannot meaningfully be unpicked afterwards.
If your account is erased at your request, what you posted stays. Your markers, routes, comments, forum posts and chat messages remain part of the Service, with your name removed so they no longer identify you. Your account, profile and private account data are deleted. The grant above continues to apply to everything already contributed. See the Privacy Policy for how to request erasure and exactly what is removed.
To the extent permitted by law, you agree not to assert moral rights in Your Content against us, insofar as this is necessary for us to exercise the licence above.
You confirm that you own Your Content, or otherwise hold all rights necessary to grant this licence, and that Your Content infringes no third party's rights. You are solely responsible for what you submit. We may remove any content at our discretion.
7. Our Intellectual Property
Except for Your Content, and for third-party material identified in Section 3, all elements of the Service, namely its source code, visual design, written text, original artwork, and the structure, selection, arrangement and presentation of the information it contains, are the property of the operator of Tabor Map and are protected by copyright.
All rights reserved. No licence to use, copy, adapt or redistribute any part of the Service is granted except as expressly stated in these Terms.
8. Database Rights
The collection of markers, routes, categories, locations, descriptions and associated data made available through the Service (together, "the Database") is a database within the meaning of §§ 87a ff. of the German Copyright Act (Urheberrechtsgesetz, UrhG). Substantial investment has been made in obtaining, verifying and presenting its contents. The operator of Tabor Map is the database maker (Datenbankhersteller) and asserts the sui generis database right under § 87b UrhG.
The extraction and/or re-utilisation of the whole or of a substantial part of the Database, evaluated qualitatively or quantitatively, is prohibited without our prior written permission. The repeated and systematic extraction or re-utilisation of insubstantial parts is likewise prohibited.
Without limiting the above, you may not:
- scrape, crawl, harvest or bulk-download content from the Service by automated means;
- copy the Database, or a substantial part of it, into another product, service, application or website;
- use the Database or any part of it to train, fine-tune or evaluate machine learning or generative AI systems;
- use the Service or the Database for commercial purposes of any kind;
- present any part of the Database as your own work.
Want to use our data anyway? Ask us. This is a community project and we are generally happy to say yes to community wikis, tools, guides and videos. Write to info@tabormap.com and tell us what you have in mind. Permission must be given in writing before you rely on it.
9. Reporting Illegal or Infringing Content
If you believe content on the Service is unlawful, or infringes your copyright or other rights, tell us and we will act without undue delay. Use the report function on the content itself, or write to info@tabormap.com.
So that we can act quickly, please include: a description of the content and where to find it, with a direct link if possible; why you believe it is unlawful or infringing; your name and contact details; and, for rights complaints, a statement that you are the rights holder or authorised to act for them, and that your notice is accurate and made in good faith.
We assess reports, remove or disable access to content where appropriate, and inform the affected user of the decision and the reasons for it. Users may contest a moderation decision through the appeal process. Unsubstantiated reports may not be actionable.
10. Security
We use HTTPS, bcrypt password hashing, input validation, rate limiting and expiring session tokens, and apply security updates as they become available. No online service can be completely secure.
If you discover a security vulnerability, please report it privately to info@tabormap.com and give us a reasonable opportunity to fix it before disclosing it publicly. We will not pursue action against good-faith security research that respects user privacy and does not degrade the Service.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind. We do not warrant that it will be uninterrupted or error-free, or that any information on it, including user-submitted marker locations and game information, is accurate, current or complete. Nothing here is official information about Ghosts of Tabor.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Service, nor for the accuracy of user-generated content.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for injury to life, body or health, for intent or gross negligence, or under the German Product Liability Act.
13. Indemnity
You agree to hold us harmless from claims, damages and reasonable costs arising out of content you submit, your use of the Service, or your breach of these Terms or of any third party's rights, to the extent those claims are attributable to you.
14. Governing Law
These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
15. Changes to These Terms
We may revise these Terms. Material changes will be announced on the Service. Continued use after a change takes effect constitutes acceptance of the revised Terms.
16. Severability and Survival
If any provision of these Terms is held invalid or unenforceable, the remainder stays in force. Sections 6, 7, 8, 11, 12 and 13 survive termination of your account or of these Terms.
